Welcome to MyHealthify Inc (“Company”, “We”, “Our”, “Us”). These Terms and Conditions (“Terms”) govern your use of our website, mobile applications (if any), and services, including the purchase of medical products, health supplements, personal care items, and FMCG goods through our platform.

By accessing or using our website, you acknowledge that you have read, understood, and agree to comply with these Terms. If you do not agree, you must immediately discontinue use of the website and our services.

1. Eligibility

• You must be at least 18 years of age or the legal age of majority in your jurisdiction to use our website.
• By using this website, you represent that you are legally capable of entering into a binding agreement.
• For products that require a doctor’s prescription under applicable laws, you agree to provide a valid prescription as and when requested.

2. Scope of Products and Services

• We provide an online platform to sell and facilitate the purchase of:
• – Prescription medicines (subject to valid prescription submission),
• – Over-the-counter (OTC) medicines,
• – Wellness & dietary supplements,
• – Personal care and hygiene products,
• – FMCG and daily essentials.
• Illustrations and Images: Product images are for reference only. The actual product (including packaging, color, batch details, or description) may vary.
• We act primarily as a reseller/marketplace unless explicitly stated otherwise. We are not the manufacturer of listed products (except where clearly mentioned).

3. Prescription Medicines

• Certain medicines are regulated under the Drugs & Cosmetics Act, 1940 and related rules in India.
• You agree to upload or provide a valid prescription issued by a registered medical practitioner before purchasing such products.
• We reserve the right to verify prescriptions and may cancel an order if:
• – The prescription is invalid or expired,
• – The details do not match the customer’s name,
• – Or the order violates any legal or compliance requirement.

4. Orders and Payments

• All orders placed on our website are treated as an offer to purchase subject to our acceptance.
• We reserve the right to accept or reject any order, in whole or in part, at our sole discretion.
• Payments must be made through UPI, credit/debit cards, net banking, wallets, or cash on delivery (if available in your area).
• Prices listed are inclusive of applicable taxes, unless stated otherwise.
• In case of pricing errors or discrepancies, we may cancel or revise orders accordingly.
• Fraudulent, abusive, or suspicious transactions may lead to order cancellation and potential legal action.

5. Shipping and Delivery

• Delivery timelines are estimates only and may vary depending on your location, stock availability, courier delays, or other factors.
• Title and risk of loss pass to you once the products are delivered at your provided address.
• You are responsible for providing accurate delivery information. Incorrect details may result in failed or delayed delivery, for which we shall not be held liable.
• Delivery may be restricted in certain regions based on legal, regulatory, or logistical reasons.

6. Returns, Refunds, and Cancellations

• Non-returnable items (due to safety and hygiene reasons):
• – Prescription medicines,
• – Opened or used consumables,
• – Personal care and hygiene products.
• Returnable items: Non-medical products (such as FMCG goods, unopened supplements, or general items) may be returned if:
• – They are unused, unopened, and in original condition,
• – Return is initiated within 7 days of delivery.
• Refunds will be processed to the original payment method within 7–10 business days after return approval.
• Cancellations:
• – Orders may be cancelled before dispatch.
• – Post-dispatch cancellations are not allowed for medicines due to regulatory restrictions.

7. User Responsibilities

• By using our services, you agree that you will:
• – Provide accurate, complete, and truthful information during registration or while placing an order.
• – Not misuse the website for any unlawful, fraudulent, or abusive purposes.
• – Not copy, modify, distribute, scrape, or attempt to reverse-engineer our website/platform.
• – Not engage in activity that could disrupt, overload, or damage our website infrastructure.

8. Limitation of Liability

• Our website and services are provided on an “as is” and “as available” basis without warranties of any kind.
• We make no guarantee that the website will be error-free, secure, or uninterrupted.
• We are not responsible for any:
• – Adverse reactions, side effects, or allergic responses to products purchased,
• – Misuse or incorrect consumption of medicines or supplements,
• – Delays or failures caused by external service providers (logistics, payment gateways, etc.).
• Medical Disclaimer: Products should be used strictly as per doctor’s advice or product instructions. We do not provide medical consultation.
• To the maximum extent permitted by law, our total liability shall not exceed the amount paid by you for the product in dispute.

11. Governing Law and Jurisdiction

• All disputes shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra.

12. Force Majeure

• We shall not be held liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, strikes, labor disputes, shortages, epidemics, government restrictions, cyber-attacks, or supply chain disruptions.
